Victoria Mediation Services (VMS) is bound by the privacy principles set out in the Privacy and Protection of Information Act (as amended from time to time) and the Law Society of British Columbia. The proper management of personal information is a priority at VMS.  VMS policies in relation to its management of personal information are set out in this Privacy Policy. In this Privacy Policy the term “personal information” refers to any information or opinion about an individual whose identity is apparent or can be reasonably ascertained from the information or opinion.

Collection

Why does the VMS collect personal information?

VMS collects personal information to fulfill functions under the Legal Profession Act. Additional information may be acquired for the purpose of research. However, such information is collected and retained anonymously.

What if I do not wish to provide personal information?

VMS is required to verify the identity of each client. Individuals seeking general legal advice – non-clients – must provide sufficient identification to ensure compliance with conflict check protocols.

How does the VMS use and disclose personal information?

VMS does not disclose personal information except as required by law and subject to solicitor/client privilege.

Data Security

VMS takes reasonable steps to keep all personal information secure and to protect that personal information from misuse or loss and from unauthorized access, modification or disclosure.  If VMS determines that personal information is no longer needed for any purpose, VMS will take reasonable steps to destroy or permanently de-identify that personal information.

When using the VMS website, or any website, you should be aware that no data transmission over the Internet can be guaranteed as totally secure. Although VMS strives to protect such information, VMS does not warrant the security of any information transmitted to it over the Internet. Any information transmitted to VMS over the Internet is done so at the risk of the person or organization transmitting the information.

Access, Corrections and Further Information

VMS endeavours to keep personal information accurate, complete and up-to-date. If any person wishes to access, review or make corrections to his or her personal information held by the VMS, the person may do so at any time by contacting VMS and arranging to attend their office in Victoria to review their file. However, VMS may refuse to provide any person with access to information where VMS is permitted by law to withhold that information, or where that information may identify the names and locations of third parties, or put any party at risk of harm.  If any person requires information about the way VMS manages his or her personal information or has any queries, problems or complaints, the person should also contact VMS on the details below.
